Terms of Service
Jones Mechanical Engineering – Terms & Conditions of Trade
Welcome to Jones Mechanical Engineering (“JME”). By engaging our services, you agree to the following Terms & Conditions.
These terms ensure clarity, fairness, and safe working practices for both parties.
1. Scope of Work
JME provides mechanical, hydraulic, and mobile repair services, including:
Mobile thread repair and extraction (“Thread Ripper”)
Broken bolt extraction and stud removal
Hydraulic cylinder inspection, resealing, repair, and pressure testing
Crane, tipper, and waste‑truck servicing
On‑site mechanical repairs and troubleshooting
Workshop repairs, machining, fabrication, and component refurbishment
Diagnostics, fault finding, and preventative maintenance
General mechanical servicing of plant, equipment, and heavy vehicles
Work is limited to what is outlined in your quote or written communication. Any additional work or changes must be approved in writing as a variation.
2. Pricing
Quotes are valid for 14 days unless stated otherwise.
Pricing is based on the described scope and excludes items listed under Exclusions.
Labour estimates may vary due to unforeseen site conditions or additional work required.
Material prices may change due to supplier fluctuations and will be passed on if applicable.
3. Payment Terms
No deposit is required unless stated otherwise.
Invoices are issued upon completion of work.
Payment is due within 7 days of the invoice date unless otherwise stated.
Overdue accounts may incur 15% p.a. interest, calculated daily and compounding monthly.
All materials and parts remain the property of JME until paid in full.
4. Working Hours
Standard working hours are Monday–Friday, 08.00am–5:00pm, excluding public holidays. Work outside these hours may incur additional charges.
5. Access & Site Requirements
Pricing assumes safe, uninterrupted access to the work area.
The customer must provide a safe working environment and comply with all health and safety requirements.
JME may refuse to work in unsafe conditions without penalty.
Delays caused by access issues or unsafe conditions may incur additional charges.
6. Subcontractors
JME may engage subcontractors where required. By accepting a quote, the customer accepts any subcontractor terms that apply to the work.
7. Exclusions
Unless specifically included in writing, the following are excluded:
Special access equipment
Hazardous material removal
Structural modifications or temporary works
Electrical, building, or painting services
Permits, consents, engineering, or certification
Testing, commissioning, manuals, or training
Insurance, bonds, or defect liability periods
Any work outside the quoted scope
8. Title & Risk
Ownership of goods remains with JME until full payment is received.
Risk transfers to the customer upon delivery or installation.
Customer‑supplied parts remain the customer’s responsibility at all times.
JME may recover supplied goods if payment is not made.
9. Liability
JME is not liable for:
Indirect or consequential loss
Damage caused by pre‑existing faults, rusted or seized components
Failures arising from customer‑supplied parts
Delays caused by third‑party contractors or site conditions
10. Customer Responsibilities
The customer is responsible for:
Providing accurate information and instructions
Ensuring all required permits and approvals are in place
Providing safe access to the work area
Maintaining equipment after work is completed
11. Defects
Any defects must be reported within 7 days of completion.
JME must be given reasonable access to inspect and remedy issues.
If no notification is received, the work is deemed accepted.
12. Returns (Supplied Goods Only)
Returns require prior written approval.
Goods must be in original condition and packaging.
A handling fee of up to 10% may apply.
Custom‑ordered or modified items cannot be returned.
13. Warranty
Parts are covered by the manufacturer’s warranty only.
Labour warranty is limited to the value of the original labour charged.
No warranty applies to customer‑supplied parts or severely worn/rusted components.
JME is not responsible for failures caused by misuse or lack of maintenance.
14. Consumer Guarantees Act
Where services are acquired for business purposes, the Consumer Guarantees Act 1993 does not apply.
15. Intellectual Property
All drawings, designs, and documentation created by JME remain the property of JME.
16. Indemnity
The customer indemnifies JME against any loss or damage arising from the customer’s actions, negligence, or failure to follow instructions.
17. Jurisdiction
These terms are governed by the laws of New Zealand.
18. Privacy
JME may collect and use customer information for service delivery, credit assessment, and account management. Information may be shared with credit agencies or debt collectors if required.
19. General
JME is not liable for delays caused by events outside its control.
The customer may not deduct or set off any amounts owed.
JME may subcontract work without consent.
Failure to enforce any clause does not constitute a waiver.
